These Terms of Service (“Terms”) apply to your use of the SOF2MP.COM website at www.sof2mp.com, its pages, tools, downloads, public data feeds and any related community services such as our Discord announcements (together, the “Site”).
Contacts: breaches of these Terms or the Use Policy: [email protected] · copyright complaints: see Copyright and DMCA below · privacy requests: see our Privacy Policy.
1. Who we are
SOF2MP.COM is an independent, non-commercial fan community for the multiplayer game Soldier of Fortune II: Double Helix. The Site is run by BuLLy in the United Kingdom. In these Terms, “we”, “us” and “our” mean the operator of SOF2MP.COM, and “you” and “your” mean anyone who visits or uses the Site.
SOF2MP.COM is not affiliated with, endorsed, sponsored, approved or authorised by Activision Publishing, Inc., Raven Software Corporation or any of their parent companies, subsidiaries or affiliates. All game names, logos, trademarks and game content belong to their respective owners.
2. Accepting these Terms
By using the Site you agree to these Terms, our Use Policy, our Anti-spam Policy and our Privacy Policy, which form part of these Terms. If you do not agree, please do not use the Site.
You must be at least 13 years old to create an account. If you are under 18, please make sure a parent or guardian is happy for you to use the Site and has read these Terms with you.
3. What the Site provides
The Site is provided free of charge. Its features currently include:
- Live server list and game statistics built from information that SoF2 game servers make publicly available to anyone who asks: server names, maps, game modes, player counts, and the in-game names, scores, teams and pings of the people playing.
- Player, clan, match, map and server pages, leaderboards, achievements, seasons, records and activity charts generated automatically from that data.
- Accounts that let you verify (“claim”) your in-game names, link older names (aliases), build a public player profile, book games, make match predictions and verify servers you own.
- The map archive: custom maps and map packs that you can browse and download.
- The CVAR database, guides, news and other informational pages.
- Public data feeds (for example our JSON API and embeddable widgets) and posts to our community Discord.
We may add, change, suspend or remove any feature at any time, with or without notice. As a free hobby project we cannot promise that any feature will remain available.
4. Changes to these Terms
We may update these Terms from time to time. The “Last updated” date at the top shows when they last changed. If a change is significant we will try to highlight it on the Site. If you keep using the Site after a change is published, the updated Terms will apply to you; if you do not agree with them, please stop using the Site and, if you wish, delete your account.
5. Your account
- Give accurate information when you sign up. An email address is optional, but without one we cannot help you reset a forgotten password.
- Keep your password secret. You are responsible for everything done through your account. Tell us straight away if you think someone else has used it.
- One person, one account. Do not create accounts for other people, share an account, or create accounts automatically.
- Do not choose a username that impersonates another person, clan, server or the Site’s staff, or that is offensive.
- You can close your account at any time from My SoF2 using “Delete my account”. What happens to your data when you do is explained in our Privacy Policy.
6. Verified names, aliases and verified servers
Verification lets you link an in-game name, or a game server, to your account so it shows a “Verified” badge.
- Only claim names that you actually use, and servers that you own or are authorised to manage.
- Claim codes are for your use only. Do not share them, display them to others or use them to claim something that is not yours.
- A verified name shows that the account holder proved control of that name in-game at the time of verification. It is not a guarantee of anyone’s real-world identity.
- If you believe someone has claimed your name, use the dispute option on the Site or contact us. We will look at the evidence and decide in good faith; our decision on who keeps a verified name is final as far as the Site is concerned.
- We may remove a verification, merge or separate names, or limit the number of claims you can make, to keep the system fair and accurate.
- If you verify a server, you confirm that the information you add to its page (such as a website or Discord link) is accurate and lawful.
7. Content you add
“Your content” means anything you add to the Site: profile pictures, taglines, bios, links, Discord names, booking names, predictions, dispute reports and anything else you submit.
- You keep ownership of your content. You give us a free, worldwide, non-exclusive licence to store, display, reproduce, resize and adapt it as needed to run and promote the Site, including in public data feeds, for as long as it is on the Site (and for a reasonable time afterwards in backups).
- You confirm that you own your content or have permission to use it, and that it does not break the law or our Use Policy.
- Profile information is public. Do not add anything you do not want the world to see.
- We do not check content before it appears, but we may edit, hide or remove any content at our discretion, for example if it breaks these Terms or is reported to us.
8. Game data and statistics
- Statistics are generated automatically from public server responses. Game servers can be misconfigured, report bots as players, go offline, change names or be shared by players with identical names, so stats, rankings, match results and achievements may be incomplete or wrong. They are provided for fun and information only.
- We may correct, recalculate, reset, merge, hide or delete statistics at any time, including to deal with errors, cheating, abuse or duplicate names.
- In-game names you use on public servers can appear on the Site. If you do not want a name tracked, see “Your choices” in our Privacy Policy.
- Our tracker sends standard status queries to servers listed on public master lists, in the same way any game browser does. If you operate a server and do not want it listed, contact us and we will do our best to stop displaying it.
9. The map archive and downloads
- Maps and map packs are works created by members of the SoF2 community and other third parties. Copyright in each map remains with its author(s). We make them available so the community can keep playing them; we do not claim ownership of them.
- Downloads are for your personal, non-commercial use with the game. Do not sell them, or remove or change any author credits or readme files they contain.
- We do not create, test or guarantee these files. Downloads are provided “as is”. You download and install them at your own risk, so keep your security software up to date and keep backups.
- To keep the archive available for everyone, downloads are subject to a fair-use limit per visitor. Do not try to get around it, for example by using automated tools or multiple addresses.
- If you made a map and would like it credited differently, updated or removed, please contact us. If you believe a file infringes your rights, see Copyright and DMCA below.
10. Our content and trademarks
Apart from your content, game data, third-party maps and the trademarks of others, the Site’s design, text, graphics, software and compilations are owned by or licensed to us. You may view, share links to and print pages for personal, non-commercial use. You may not copy, republish or sell substantial parts of the Site without our written permission, except as allowed by law or by the API terms in section 11.
Soldier of Fortune II: Double Helix and all related names, logos, images, trademarks and game content are the property of their respective owners and are used on the Site only for identification and informational purposes. No claim of ownership is made, and no infringement is intended.
11. Public data feeds, widgets and automated access
- You may use our public JSON API and embeddable widgets for non-commercial community projects (for example clan websites, Discord bots and stream overlays), as long as you credit SOF2MP.COM with a link and keep request volumes reasonable.
- Cache responses where you can. Do not poll more often than every couple of minutes, because the underlying data does not change faster than that.
- Do not scrape the Site in a way that harms its performance, try to get around rate limits or security measures, or use our data to harass, track or profile individual players.
- We may change, limit or withdraw the API or widgets at any time, and may block access that we consider abusive.
12. Acceptable use
You must follow our Use Policy and Anti-spam Policy. In short: be decent, do not break the law, do not impersonate people, do not spam, and do not attack or overload the Site, the game servers or other players.
13. Copyright and DMCA
We respect the intellectual property of others and expect our users to do the same. We will remove or disable access to material on the Site when we are properly told that it infringes someone’s copyright or other rights, and we will close the accounts of repeat infringers where appropriate.
We are based in the United Kingdom and handle notices under UK law. We also accept notices in the format set out in the United States Digital Millennium Copyright Act (17 U.S.C. § 512) and deal with them in the same way.
13.1 Sending a notice
If you believe material on the Site (for example a map file, an image or text) infringes your copyright or other intellectual property rights, email [email protected] with the subject line “Copyright notice” and include:
- your full name, email address and, if you are acting for someone else, the name of the rights holder you represent;
- a description of the work you say has been infringed;
- the exact web address(es) on the Site where the material appears (for a map, its page or download link);
- a statement that you believe in good faith that the use is not authorised by the rights holder, its agent or the law;
- a statement that the information in your notice is accurate and that you are the rights holder or are authorised to act for them; and
- your physical or electronic signature (typing your full name is enough).
Please only use this address for intellectual property notices. Notices that are clearly abusive or knowingly false may themselves be unlawful, and we may share them with the person affected.
13.2 What we do
When we receive a complete notice we will act promptly to remove or disable access to the material, normally within 7 days. Where we can identify the person who added it, we will let them know and give them a copy of the notice, with personal contact details removed where appropriate. Because most map files were made by third parties and collected by the community over many years, we may simply remove a disputed file rather than investigate it.
13.3 Counter-notices
If material you added was removed and you believe that was a mistake, or that you have the right to use it, you may send a counter-notice to [email protected] including: your name and email address; the material that was removed and where it appeared; a statement that you believe in good faith that it was removed by mistake or misidentification; and your signature. If you are outside the United States and wish to rely on the DMCA counter-notice process, also include a statement that you consent to the jurisdiction of the courts for the place where you live, or of any court where we may be found. We may restore the material if the original complainant does not tell us within 14 days that they have started legal action, but we are not obliged to do so.
14. Third-party sites and services
The Site links to, and relies on, things we do not control. These include game servers, the public master server list, Discord, clan and server websites, and the services that help run the Site. We are not responsible for their content, availability, security or privacy practices, and a link is not an endorsement. Joining a game server is a matter between you and the people who run that server, and their own rules apply.
15. Suspension and termination
We may warn you, hide your content, remove verifications, restrict features, or suspend or delete your account, with or without notice, if we reasonably believe you have broken these Terms or the law, or if your use creates a risk for the Site or other people. You may stop using the Site and delete your account at any time. Sections 7 (licence for content already published, for a reasonable period), 9, 10, 13, 16, 17 and 19 continue after your account ends.
16. No warranties
The Site is a free, volunteer-run community project provided “as is” and “as available”. To the extent the law allows, we make no promises that the Site, its statistics, downloads or data feeds will be accurate, complete, uninterrupted, secure or free from errors or harmful components, or that they will be suitable for any purpose. Nothing in these Terms affects any rights you have under law that cannot be excluded.
17. Our liability to you
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited or excluded by law.
Subject to that:
- we are not liable for any loss or damage that was not reasonably foreseeable, or for any loss of data, profits, business, reputation or goodwill;
- we are not liable for losses caused by third-party content, maps or other downloads, game servers or third-party services, or by events outside our reasonable control; and
- because the Site is free, our total liability to you for all claims connected with the Site is limited to £50.
If you are using the Site for any business or commercial purpose, we have no liability to you for any loss of profit, loss of business, business interruption or loss of business opportunity.
18. Your responsibility for misuse
If you break these Terms or the law when using the Site, for example by uploading infringing content or attacking the Site, you are responsible for the reasonable costs, losses and claims that we suffer as a direct result.
19. General
- Governing law: these Terms are governed by the law of [England and Wales. The courts of England and Wales will have jurisdiction, but if you live in Scotland or Northern Ireland you may also bring proceedings there, and if you live elsewhere you keep any protections that the mandatory law of your home country gives you.
- Whole agreement: these Terms, together with the policies they refer to, are the whole agreement between you and us about the Site.
- Severability: if a court decides that part of these Terms is invalid, the rest stays in force.
- No waiver: if we do not enforce a right straight away, we can still enforce it later.
- Transfer: we may transfer the Site and these Terms to another person who agrees to keep running it under terms at least as protective of your data; we will post a notice on the Site if this happens. You may not transfer your account.
- Third parties: nobody other than you and us has any right to enforce these Terms.
